§ 106.213. Appropriation of revenues not budgeted.

  • No revenues not budgeted in the budget ordinance or any other appropriation ordinance, whether derived from new sources of revenue or from overcollections of budgeted sources of revenue, and specifically including federal and state grant revenues, shall be encumbered or expended by the City or any independent agency without prior appropriation thereof by the Council except that the Mayor may appropriate new estimated revenues not to exceed $25,000, provided such appropriations are made within the same subfund to an existing budgetary line item. The Mayor is also authorized to transfer amounts from the Executive Operating Reserve account to any other major fund or sub-fund without further City Council action. With respect to concession activities operated by the City, if actual gross sales exceed the estimated sales budgeted by the Council, the Mayor may utilize the additional revenues arising therefrom to cover the cost of merchandise required to meet the additional sales, and for that purpose such additional revenues are appropriated. Notwithstanding the prohibition contained in the first sentence of this Section, revenues arising solely from the overcollection of a budgeted source of revenue by any Enterprise Fund activity of the general government or by an independent agency may be used to pay any outstanding obligations of the activity or independent agency that were in existence before the collection of the additional revenue, and for that purpose such additional revenues are appropriated.
