§ 114.205. Assumption of powers and duties of office.

If, in the event of an attack, the incumbent of an office and any duly authorized
deputy is unavailable, the emergency interim successor to that office who is highest
in rank in order of succession and who is not unavailable shall, except for the power
to appoint emergency interim successors, exercise the powers and discharge the duties
of the office. An emergency interim successor shall exercise the powers and discharge
the duties of the office only until such time as the incumbent, or any duly authorized
deputy, or an emergency interim successor higher in rank in order of succession becomes
available to exercise the powers and discharge the duties of the office or until,
where an actual vacancy exists, a successor is appointed or elected and qualified
as provided by law.
