Nothing in the Zoning Code shall be deemed to require a change in plans, construction
or designated use of a building or structure in compliance with this Zoning Code prior
to September 5, 1969, or prior to the date hereof or any amendment and for which (i)
a permit has been issued by the Building Inspection Division prior to September 5,
1969, or prior to any amendment thereto, or (ii) an application for a permit has been
submitted to and accepted by the Building Inspection Division prior to September 5,
1969, provided the application is diligently prosecuted to permit issuance.
