§ 656.709. Nonconforming structures unsafe because of maintenance.

If a nonconforming structure or portion of a structure or a structure containing a
nonconforming use becomes physically unsafe or unlawful due to lack of repairs or
maintenance and is declared by a duly authorized official of the city to be a condemned
building, unfit for occupancy, it shall not thereafter be restored, repaired or rebuilt
except in conformity with the regulations of the district in which it is located.
However, where a structure originally constructed for residential use as determined
by the city is a landmark or a contributing structure in an historic district pursuant
to a city ordinance or is a structure that is at least 50 years old and is located
within the boundaries of a designated historic district, such originally-constructed-for
use may be reconstructed at any time notwithstanding the condemnation and be consistent
with the Comprehensive Plan. Any reconstruction pursuant to the above shall comply
with the Secretary of the Interior's Standards for Rehabilitation.
