§ 73.101. Created; terms of office; appointment and removal.

  • (a)

    There is created an Environmental Protection Board (hereinafter referred to as the Board ) consisting of 9 members to be appointed within the following categories:

    (1)

    Two members shall be representatives of industries affected by and subject to the Board's jurisdiction.

    (2)

    One member shall be a member of a recognized conservationist organization or a sport or commercial fisherman of recognized standing.

    (3)

    Two members shall be professional engineers registered in the state.

    (4)

    Two members shall be from the medical profession.

    (5)

    Two members shall be discreet citizens representing the general public.

    (b)

    Members shall be appointed by the Council or by the Mayor for a term of four years each, as follows:

    (1)

    The Council President shall nominate and the Council shall appoint one member in each of the categories numbered (1), (3), (4) and (5) in subsection (a) of this section. A member appointed by the Council may be removed by the Council.

    (2)

    The Mayor shall appoint and the Council shall confirm one member in each of the categories numbered (1), (2), (3), (4) and (5) in subsection (a) of this section. A member appointed by the Mayor may be removed by him, subject to the concurrence of the Council.

    (c)

    Once appointed, the members of the Board shall continue in office until the expiration of their terms of office, or until they are reappointed and confirmed or until their successors have been appointed and confirmed. Appointments shall be made according to the provisions of subsections (a) and (b) of this section; the first vacancy occurring in each category shall be filled by appointment by the Council and the second vacancy occurring in each category shall be filled by appointment by the Mayor.
