§ 106.442. Expenditure of funds when no budget ordinance adopted.

  • If, by the first day of the fiscal year, there has been no budget ordinance enacted for that fiscal year, then the Mayor is authorized to expend any funds that may be available in the City Treasury and not otherwise encumbered, impounded or previously restricted as to manner or purpose of disbursement on a monthly basis in an amount equal to one-twelfth of the previous fiscal year annual appropriations so long as funds are available. The funds so expended shall not be utilized to fund new positions that may be established within the government; nor shall these funds be expended for salary increases or raises except as may be required by statute or pursuant to contractual obligation for salary increases or other benefits resulting from promotion of employees; nor for any new capital outlay expenditures.
