§ 111.230. Duval County Alcohol and Other Drug Abuse Trust Fund.

  • (1)

    There is hereby created a trust fund to be known as the Duval County Alcohol and Other Drug Abuse Trust Fund, hereinafter called the Trust Fund, into which shall be deposited all monies remitted to the County pursuant to:

    (a)

    F.S. § 939.017 that were collected as additional costs imposed by the courts for misdemeanor convictions involving the unlawful use of drugs or alcohol, or,

    (b)

    F.S. § 893.165 that were collected as additional assessments imposed by the courts pursuant to F.S. § 893.16, for criminal offenses under F.S. Ch. 893, or,

    (c)

    Other lawful sources including, but not limited to, donations, contributions, gifts and grants received from governmental and nongovernmental entities for the purpose of planning, developing, evaluating, providing or enhancing substance abuse services for Duval County residents.

    (2)

    These monies, together with any interest earned or accrued thereon, shall be used only for the support of Duval County based substance abuse programs which meet the Florida Department of Children and Families standards of qualifications for such programs. The Director of Finance and Administration is authorized and directed to make disbursements, subject to the availability of funds within the Trust Fund, upon written requisition of the Director of Recreation and Parks or designee, for the purpose of planning, developing, evaluating, providing or enhancing/expanding substance abuse services for the residents of Duval County. Provided, however, that all expenditures of monies from this Trust Fund shall be subject to prior approval and appropriation by the Council and based upon the success and/or desirability of the programs. Any recipient of these funds shall provide the Council with detailed information as may be required by the Council.

    (3)

    The monies in this trust fund shall be appropriated by the Council prior to expenditure and shall not lapse at the end of any fiscal year but shall remain available for expenditure as lawfully appropriated by the Council. The Clerk of the Circuit and County Courts shall provide to the Director of Finance and Administration and the Council Auditor, on a monthly basis, the amounts of additional assessments imposed and collected by the courts pursuant to F.S. § 939.017 and F.S. § 893.16.

    (4)

    In no case whatsoever shall these trust funds be utilized to supplant general fund dollars currently allocated and appropriated for the provision of comprehensive substance abuse services for the residents of Duval County.
