§ 111.388. Recording Fees Technology Special Revenue Fund.

  • There is hereby established a trust fund to be known as the Recording Fees Technology Trust Fund , the "Fund" Section 28.24(12), F.S, allows the Clerk to charge specified fees and requires a portion to be distributed to the City Council to be used exclusively for court-related technology, and court technology needs as defined in Sections 29.008(1)(f)2 and (h), F.S., for the state trial courts, state attorney, and public defender in that county. Such court-related technology includes, but is not limited to, computer networks, systems, and equipment as well as existing multiagency criminal justice information systems. The monies deposited in the Fund are subject to annual appropriation by the City Council pursuant to the annual budget approval process. The Director of Finance and Administration shall disburse and account for the funds upon written request which bears the confirming signature of each the Chief Judge, State Attorney, and Public Defender for the Fourth Judicial Circuit. Revenues in excess of the annual appropriation approved during the budget approval process shall be available only to fund court-related technology for the state trial courts, state attorney and public defender after approval by the City Council through separate legislation. Any unspent funds remaining and/or unencumbered in the Fund at the end of the fiscal year shall remain within the Fund's fund balance and shall only be used to fund court-related technology for the state trial courts, state attorney and public defender.
