§ 111.396. Motor Vehicle Safety Program Fund.

  • There is established a Motor Vehicle Safety Fund ("fund"), into which shall be deposited all donations and gifts of money which are given to the City or the Office of the Sheriff for use in motor vehicle safety programs of the Office of Sheriff, subject to the terms and conditions of the donation or gift or, if no terms or conditions are attached, for any of these programs. The purpose of the trust fund is to provide funding to: a)educate youth regarding the issues of illegal drugs and alcohol; b) educate individuals about the horrors of alcohol and drug impaired driving; and c) educate the general public regarding the dangers of street racing and to promote racing activities in facilities designated for such purposes that are controlled by sanctioning bodies with expertise in safely conducting the activities; and d) promote relationships between law enforcement and the community. The donations and gifts shall be used to obtain necessary equipment and services and to pay operating expenses associated with the programs including conversion, transportation and operating costs of motor vehicles and the cost of promotional and educational materials and other training aids directly related to and used for the promotion of motor vehicle safety by the Office of the Sheriff. The Director of Finance and Administration is authorized and directed to make disbursements from this fund upon written requisition of the Sheriff or his designee, up to $5,000 per item without additional Council review or approval until September 30, 2009. After such date all disbursements will be subject to Council approval as a part of the annual budget ordinance or by separate appropriation. All monies placed in the fund are hereby appropriated for the purposes of the fund and shall not lapse at the end of any fiscal year but instead shall carry over to the next fiscal year. Support of the vehicle shall be solely paid for from funds received from donation not supported by any other City funds.
