§ 122.106. Public hearing required for closing or change of use of fire stations or libraries.
Prior to the closing or a substantial change in the use of a fire station or library in the City, the Mayor is required to issue a proposed closing or substantial change in use order and file a copy of same with the Council Secretary. Upon receipt of such proposed order, the Council Secretary shall cause a resolution to be prepared and presented to the Council for consideration. The Council Secretary shall also publish at least a 14-day notice calling for a public hearing by the Council on whether the fire station or library should be closed or utilized for any other purpose. The Council Secretary shall also provide for the posting of a sign along the nearest street right-of-way adjacent to the facility proposed to be closed or its use substantially changed. The sign shall be posted at least ten days prior to the scheduled public hearing and shall contain information thereon concerning the proposed closure or substantial change of use and the date, time and place of the scheduled public hearing concerning same. The Mayor shall not issue a final closing or substantial change in use order until the Council has approved such action and the Mayor's final closing order shall include such findings, modifications and conclusions supporting the action taken by the Council.
