§ 122.703. Registration with state.

  • The Mayor is authorized to register service marks with the Florida Department of State under the provisions of F.S. Ch. 495. In those instances where the Mayor applies for registration of a service mark with the Commissioner of Patent and Trademarks, he shall also apply for registration with the Department of State under this Section, if the service mark is registerable under Florida law. If a service mark is registered by the Department of State, the provisions of Sections 122.701(b) and 122.702, to the extent that these provisions are recognized under Florida law, shall apply to the registered service mark. Registration of a service mark under this Section is independent of, and is not a condition precedent to, registration under Section 122.701.
