§ 111.530. Fair Share Sector Areas Transportation Improvements Special Revenue Fund.
There is hereby created the Fair Share Sector Areas Transportation Improvements Special Revenue Fund which shall consist of the following accounts:

Urban Core Planning District, Sector 1-1.
(2)
Greater Arlington Planning District, Sector 2-1.
(3)
Greater Arlington Planning District, Sector 2-2.
(4)
Southeast Planning District, Sector 3-1.
(5)
Southeast Planning District, Sector 3-2.
(6)
Southeast Planning District, Sector 3-3.
(7)
Southeast Planning District, Sector 3-4.
(8)
Southwest Planning District, Sector 4-1.
(9)
Southwest Planning District, Sector 4-2.
(10)
Northwest Planning District, Sector 5-1.
(11)
Northwest Planning District, Sector 5-2.
(12)
North Planning District, Sector 6-1.
(13)
North Planning District, Sector 6-2.
Each sector is shown on the Fair Share Fund Sector Areas Map. The map and the boundaries of each sector are included within the Concurrency Management System Handbook.
Funds deposited into this special revenue fund shall be segregated into accounts, according to the sectors specified hereinabove. The funds shall be automatically appropriated into a sector reserve account for further appropriation by City Council. The funds collected pursuant to a fair share assessment contract shall be assigned to the appropriate account for the affected sector. When the proposed development lies in or affects more than one sector, the Director of Planning and Development and the Director of Public Works shall in their sole discretion, determine whether to deposit the funds into the account for one sector or to allocate the funds between or among the accounts for the other affected sectors.
Funds within each account shall be appropriated within a reasonable period of time, not to exceed five years from deposit, only for specific new or existing transportation projects which are located within the same sector for which the account was created and which will improve the level of service on roadways which serve or are reasonably related to the proposed development, as determined by the Director of Planning and Development and the Director of Public Works pursuant to Section 655.303(f). Appropriated expenditures from the fund balance of each account shall be made prior to or contemporaneously with the expenditure of other public funds to fund such transportation projects within the particular sector for which the account was created, and the Director of Finance and Administration is authorized to make disbursements from the fund balance of each account upon the request of the Director of Public Works.
