§ 122.817. Weapons and firearms in custody of Sheriff.

  • (a)

    Weapons and firearms in the custody of the Sheriff as a result of arrests, abandonment or otherwise obtained shall, if not required as evidence in court and not reclaimed by the lawful owner thereof within six months from the date they came into the custody of the Sheriff's Office, become forfeited to the City.

    (b)

    A weapon suitable for use by the Sheriff may be used by him. A weapon or firearm which is not needed by his Office or which is useless or unfit for use shall be destroyed by him. A weapon which, in the opinion of the Sheriff, is considered to be designed principally for sporting purposes shall not be destroyed but shall be disposed of by public auction to the highest bidder. Proceeds from these sales shall be remitted to the General Fund-General Services District.

    (c)

    A report of firearms and weapons destroyed shall be made and kept by the Sheriff. The report shall contain the make, model, serial number and other complete description of each weapon, together with the date and method of destruction.
