§ 122.816. Donation, destruction or abandonment of valueless tangible personal property.

  • If tangible personal property no longer used or needed by the City is without commercial value, it may be donated, destroyed or abandoned pursuant to this Section. The Chief of Procurement shall certify that the property is valueless and:

    (a)

    With respect to property that may still have a use, shall offer the property for donation to public or private institutions that may request its donation and for which property the institutions can show a need. The Chief of Procurement shall transmit to the Awards Committee the names of not less than three institutions that have expressed a desire to have the property donated to them, and the Awards Committee shall select one of the institutions to which the property is to be donated. Upon approval by the Mayor, the property shall be transferred to the institution, and the Mayor and Corporation Secretary shall execute the necessary instruments to transfer the City's interest. If less than two institutions respond to the offer, the Chief of Procurement shall submit the names of responding institutions to the Awards Committee. The Awards Committee may decline to select an institution but authorize the Chief of Procurement to destroy or abandon the property. Action taken under this subsection shall be noted in the property records maintained by the Accounting Division.

    (b)

    If the property has no remaining use or if it is authorized for destruction or abandonment as provided in subsection (a) of this Section, the Chief of Procurement shall cause the property to be destroyed in a safe, lawful manner or shall abandon the property by disposal in a safe, lawful manner. The fact of destruction or abandonment shall be noted in the property records maintained by the Accounting Division.
