§ 220.218. Registration of color schemes, business names and commercial identification.

  • (a)

    The color scheme, business name and commercial identification under which a vehicle for hire is operated shall be registered with the Department in accordance with the rules promulgated by the Director. Each color scheme, business name and commercial identification shall be sufficiently distinctive as not to cause confusion with other for-hire businesses already operating in the City, unless the agreement required by Section 220.202(b) is on file with the Department. The Department, when investigating an application filed under Section 220.202, may reject the color scheme, business name or commercial identification if it is confusingly similar to a scheme, name or identification already registered with the Department, subject to appeal to the Director, whose decision shall be final under Section 220.204.

    (b)

    An owner may, at any time, abandon or change the color scheme, business name or commercial identification registered by him with the Department by filing with the Department a notice, in a form approved by the Director, indicating the abandonment or change and the new scheme, name or identification, if any. The requirement for distinctiveness shall apply to the new color scheme, business name or commercial identification (unless the notice is accompanied by the agreement of the existing owner of the scheme, name or identification to its use) and a notice may be rejected and registration of the new scheme, name or identification refused for failure to adhere to this requirement.

    (c)

    A registration may be transferred from one owner to another owner by their jointly filing a notice, in a form approved by the Director, with the Department specifying what element of the registration is being transferred. The Department shall note the fact of the transfer in its records and the transferee shall thereafter be recognized as the registered owner of the color scheme, business name or commercial identification transferred in the notice.

    (d)

    The provisions of this Section 220.218 shall not apply to limousines as defined herein.
